Hallo, ich möchte gerne eine Aussage zu Covid 19 überprüfen. Besteht ein Patentantrag zu einem Mobilephone Chip seit 2015? Dazu bitte die nötigen Informationen. BR Manfred Lietz

US patent application, US2020279585 (published in our online patent database Espacenet, is a US patent application pending before the USPTO and being treated according to applicable US patent law, and US patent law allows changes to appending patent application to a certain extent (“Continuation in part”).

The patent application in question concerns a system for acquiring and transferring biometric data from a user. it was first filed in 2015, with subsequent changes added in 2016, 2017, 2019 and 2020.

The application that contains a reference to COVID-19 was filed on 5 May 2020, and was published in September 2020. None of the other versions contain any reference to a virus infection, but only in one case mention a “medical condition” of a user. Therefore, the patent application filed in 2015 is not related to COVID-19 in any form, but to the acquiring and transferring biometric data from a user.

So a patent can be sumbitted and then have its original name and description changed later?

So the name of the 2015 application and its description has been retrospectively changed?

However,

suggests this is not possible:

"Matter not found in either, involving a departure from or an addition to the original disclosure, cannot be added to the application even if supported by a supplemental oath or declaration, and can be shown or claimed only in a separate application."

Please note that the patent application in question is a US patent application. As mentioned in the EPO post at 14:30 on Wednesday, 7 October, the patent application is pending before the USPTO and being treated according to applicable US patent law. The US system, which is different from the European one, allows an applicant to file a patent application which relates in some substantial portion to an invention already disclosed in an earlier filed application, but at the same time add some information. This is called “continuation in part”.
