India: Public invited to submit views on SEPs issues

Dear users,

This is to inform you that on 1 March 2016, the Government of India Department of Industrial Policy and Promotion Ministry of Commerce & Industry published a discussion paper on Standard Essential Patents (SEPs) and their availability on FRAND (Fair, Reasonable, and Non-Discriminatory) Terms. The public has been invited to express their views and suggestions on 13 points raised in the concluding section of the paper titled “Issues for Resolution” by 31 March 2016.

As the Indian law covering the FRAND licensing practices for standard-essential patents is still in the development phase we decided to inform you about the possibility to express your views on this subject.

Among the points identified for discussion and consultation with the public are for example questions whether the existing provisions in India are sufficient to address the SEPs under FRAND terms, what should be the IPR policy of Indian Standard Setting Organizations in developing standards for telecommunication sector or what is the process of determining that a particular patent is actually an essential patent.
