Japan: English Q&A on trial and appeal procedures available

Dear users,

Since the re-introduction of post-grant opposition in Japan on 1 April 2015, the Japan Patent Office (JPO) has received many questions regarding the different trial and appeal procedures.

To answer these enquiries, the JPO has recently made a number of Q&A in English available on its website.

The questions have been grouped and consolidated according to the specific trial procedures (e.g. trials for invalidation, opposition for patents, appeal against an examiner’s decision for refusal). Questions in each sub-group can be downloaded in the pdf form.

a trial for invalidation is a means established to legally invalidate a patent right or a utility model right , design right, or trademark right, that was granted fir an invention or trademark etc. but which should have been rejected by law.under such circumstance, a trail for invalidation declares that the patent right or registration right never existed in the first place.

patent rights and other rights that were invalidated are regarded to have never existed and the validity of such rights will be extinguished retroactively to the time when such rights became effective.
