Patent Question

I am looking to take the first steps on an idea I had and, was wondering, has anyone used LegalZoom to help patent their idea? Or, has anyone has used other, better, means to get their idea patented? Does LegalZoom actually look to see if someone else already has the patent? Generally, just seeking others experiences with getting an idea patented.

The idea I have is already in use by mechanics, but I would like to change the metal parts to plastic or rubber and make it look more kid friendly. Then market the product towards mothers and their kids. I haven't found anything on Amazon that remotely resembles this product other than in the car section. I did find two random websites with similar products for the same use, but one was discontinued and both were different enough in design. Both were/are not marketed towards mothers/kids. Which is the area I think has the best potential.

Dear farukhcasy2,

Please note that The European Patent Office’s main task is to examine and grant patents in the technological and chemical fields. So the European Patent Office deals only with patent applications and does not register products.

Maybe it would be helpful to get in touch with the national IP offices of the EPO member states or the national IP offices outside the EPO, where you could obtain more information on products and trademarks.

Additionally the European Union Intellectual Property Office (EUIPO) in Alicante might be able to help you further as it grants patents for products, designs, logos, trademarks, brands, etc.
Or you simply contact a patent information centre close to you.

Please keep also in mind, that search strategies can be very complex and have to be done by professionals in order to minimise and hopefully eliminate any financial risk. To be sure if you can commercialise or patent your idea we would suggest you to contact a patent attorney, who could check if your product is patentable and if you can commercially use it. Here you can find a list of EP representatives in case you want to apply for a patent.
