PCT data in priority claims

Hi,
I am using the Published Data Retrieval api to obtain information about Chinese patents. In one scenario in which the Chinese patent is a national phase of an international (PCT) application, the PCT details are listed under the <priority-claims> tag. Accordingly, there does not appear to be an easy way to distinguish between details of actual priority claim and details of the PCT application (which are not technically priority claims).
Any suggestions for identifying PCT details as distinct from priority claims?
Many thanks

Hi,

Good indicator is so called "priority linkage type" that we display in OPS family service:

.../rest-services/family/publication/docdb/CN.1341753.A/
Capture_lt.PNG

Linkage types description for WO:

A : PCT application claimed from national procedure
W : Additional PCT application
0 : Prior application claimed for an addition
1 : Prior application claimed for continuation
2 : Prior application claimed for continuation in part
3 : Prior application claimed for a division

Linkage types description for CN
A : PCT application claimed from national procedure
W : Additional PCT application
0 : Prior application claimed for an addition
3 : Prior application claimed for a division

See DOCDB Manual for other linkage types according to countries: https://www.epo.org/searching-for-paten ... nuals.html

We have huge collection of biblio, dating back to into 1700's so I cannot guarantee that LT is always available but it will be there for newer data.

Also, an indication of PCT is a W (see Kind) in a priority/application DOCDB format number in biblio, in all services.

Thank you. That is very useful.

For the Chinese patent data in Espacenet, is it updated to reflect changes in the CN register e.g. changes of applicant name, or is it simply a snapshot of the patent data at publication? In other words, is the data frequently updated to reflect the current state of the CN patent register for each published case?

Many thanks

That depends what you are looking at, actually. Espacenet is a prior art database of published data as filed at the time, but Espacenet also has "Legal events" part that shows some changes from various registers of national offices, including CN. Changes or names or assignments would be in legal events.

But the database that better reflects changes during procedure would actually be DOCDB database - 14.7 Worldwide bibliographic data (DOCDB) in a bulk https://www.epo.org/searching-for-paten ... docdb.html .

Still, DOCDB will not have legal events in his set, but will reflect changes and updates of biblio (like current designations, classification changes, family and citation updates and some name or title changes in some cases).

Most users buy 14.7 and 14.11 Worldwide legal evets data (INPADOC) when they need such updates and have a database>/storage/repository to host all that data or they get one or more licenses to GPI: https://www.epo.org/searching-for-paten ... t/gpi.html if they only want to search such data. GPI is built on DOCDB and INPADOC basis.

But we don't have API with DOCDB biblio. Future version of OPS should be linked to DOCDB, but I cannot give any timeline on that at this point.
