Some patents not found

Post by ArnauC » Tue Oct 26, 2021 10:49 am

Hi all,
I'm experiencing that some of the patents I'm looking for through the OPS API are not found while others are, and I do not understand why is that, if there is any underlying difference or any explanation.
Examples:

http://ops.epo.org/3.2/rest-services/pu ... escription: FOUND
http://ops.epo.org/3.2/rest-services/pu ... escription: FOUND
http://ops.epo.org/3.2/rest-services/pu ... escription: NOT FOUND
http://ops.epo.org/3.2/rest-services/pu ... escription: NOT FOUND

Any reason why some are found and some are not?

Thank you in advance

Hi,

Both documents NOT Found are not republished EURO_PCT's under article 153(3) of the EPC: https://www.epo.org/law-practice/legal- ... ar153.html, which means that WO document's full text fully replaces of EP laid open publication's full text, so in order to get description and claims, you have to search in OPS with corresponding WO publication numbers.

If you don't know which they are, just do either normal biblio or equivalents search with that EP first to find related WO number.

Hi Vesna, first of all thank you for your reply.
Recently I have come back to this issue, and I'm still experiencing some difficulties as I am not always capable to resolve the WO publication number from the EP document.

As an example, patents EP3675838A1 and EP3760189A1 are not found in OPS, but when I search for equivalents or biblio, I don't see their respective WO numbers.

Is there a systematic way to recover the related WO number of an EP patent?

Thank you,

Arnau

Hi,

Just now I tried both numbers, for the first one there is a family issue, I asked colleagues to fix that and for your second number I get this:

..../rest-services/published-data/publication/epodoc/ep3760189/equivalents

Do you see that when you call the request?

Please note that your second document has also an issue with a wrong kind code (should be A1, but is at the moment A4) and that will also be fixed tomorrow. But if you don't use kind code for equivalent search - which makes sense since family is same for entire invention, no matter wich publication step - then the family is retrievable already.
