Subsequently filed PCT documents

Post by basjan » Wed Oct 19, 2011 9:19 am

We were about to use the subsequently filed PCT documents, when we came accross the following questions:

- You have to enter a Filing Office. This does not list the European Patent Office, while we did file the PCT application at the EPO. What should we do ?

- At the names tab, you can only enter the Applicant and a Contact person, while I would expect to enter the name of the agent. What should we do ?

Regards

Dear basjan,

The PCT subsequently filed documents are only accepted by the offices listed in the drop down list of filing offices – OEPM (ES), PRH(FI), UKIPO(GB), PRV(SE) and NIPO(NL).
At the moment the PRV, PRH and NIPO are accepting these filings. The UKIPO and the OEPM will follow next week.
At present (and in the near future at least) it won’t be possible to file the PCT subsequently filed documents online to the EPO.

Regarding the Names tab; since the information about applicants and agents is known from the original PCT filing, the Names tab is only used:
- to specify the first Applicant, so that it can be double checked against the first applicant named in the original filing (defined by application number).
- to specify the person to be contacted in case of questions related to the Subsequently filed document(s).

To submit any changes to the applicants, agents, or inventors – i.e. changes under PCT Rule 92bis - you can attach a document under the category Changes to indications in the Request (Rule92bis).
Assignments may also be attached.
regards,
