Unitary Patent transition period and delay in decision to grant

1 January 2023 sees the start of the "transition period" at the EPO. For applicants wishing to get a Unitary Patent, this means that you can now request the EPO to delay the decision to grant (you must use EPO Form 2025 to do this). Delaying the decision will ensure that it is not issued before the date on which the UPCA enters into force (expected on 1 June of 2023). You can now also file early requests for unitary effect (we recommend that you use EPO Form 7000 to do this).

Any request for deferred publication will be published in the All documents panel of the European Patent Register, whereas any request for unitary effect will be published in the new Register for unitary patent protection (publication expected to begin on 8 June 2023).
