Unpublished European Patent Applications

Post by alfred » Sun Apr 05, 2020 9:42 pm

Dear ladies and gentlemen,

how can I found the title and the application number of an unpublished European patent application for Article 87(4) EPC?

Of course, the content of an unpublished European patent application is not available but it must be possible to get the title, application number, and the date of withdrawal, deemed to be withdrawn or rejection.

Hi

Only number and date of withdrawal (or deem withdraw) or rejection will be available and you will find this in every weekly issue of European Patent Bulletin: https://www.epo.org/searching-for-paten ... nload.html and EBD (similar data set but available for machine-readable access to data): https://www.epo.org/searching-for-paten ... html#tab-1

Hi Vesna,

thank you for your response including the links.

However, the bulletin only contains the data of publications which has been published. Also information about the withdrawal, refusing, and withdrawal fiction can merely be found for published European patent applications. The respective information cannot be found for unpublished[/b] European patent applications.

Greetings,

Alfred

Hi,

I am sorry, I didn't see your replay before.
As far your last question, we have no other sources to offer.
Something that is not-published will only be disclosed to the rightful applicant and his representative but not to the third party.

Regards,

Vesna for OPS and bulk data

Hi Vesna,

in your Post dated April 10, 2020, you have stated the following:

"Only number and date of withdrawal (or deem withdraw) or rejection will be available and you will find this in every weekly issue of European Patent Bulletin: https://www.epo.org/searching-for-paten ... nload.html and EBD (similar data set but available for machine-readable access to data): https://www.epo.org/searching-for-paten ... html#tab-1"

Can you explain, how can I find the number and date of withdrawal of an unpublished European patent application?

It is clear that the content of an unpublished European patent application cannot be obtained. However, it is interesting if information such as the title, number and date of withdrawal can be found somewhere.

Kind regards,

Alfred
